legal Issues


Mr. Jones was a paying guest at the Royal Lodge Motel in Trenton, New Jersey. Mr. Jones was a member of the Automobile Club of New Jersey. The Auto Club publishes a ?Tourbook? in which it lists hotels and motels and rates the quality of their services, including the cleanliness of rooms, quality of the restaurant, level of personal service, and the like. Mr. Jones had selected the Royal from the Tourbook. On the night of his stay at the Royal, Mr. Jones was shot in the parking lot adjacent to the motel and died as a result of his injuries. Mr. Jones? widow sued the Auto Club for negligence.
In view of these facts, analyze the problem and justify your decision from a legal and ethical standpoint by answering the following issues:
1. What must the plaintiff prove in this case to be successful in a negligence lawsuit? Define and explain.
2. Did the Auto Club or the plaintiff act ethically in this case? Discuss and explain.
3. Is the Auto Club liable? Why or why not?
